1. Eligibility: The 36 Cube Contest (“Contest”) is open to legal residents of the 50 United States or the District of Columbia, 18 years of age or older at time of entry. Void where prohibited. Employees, officers and representatives of Think Fun, Inc., as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, state and local laws and regulations. Participation in the contest constitutes entrant’s full and unconditional agreement to these official Rules and Sponsor’s and administrator’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor and Administrator: Think Fun, Inc., 1321 Cameron Street, Alexandria, VA 22314.
3. Contest Period: The Contest begins on January 1, 2009, at 12:00 a.m. Eastern Time (‘ET”) and ends on April 1, 2009 at 11:59 p.m.ET (the “promotion Period”). Administrator’s computer is the official time keeping device for the Contest.

How To Enter: Send an email with your name, email
address, mailing address, age and two photos to 36cubecontest@thinkfun.com. The
first photo must show the entire top of the 36 Cube puzzle completed and solved;
the second photo must show one entire side of the same 36 Cube puzzle completed
and solved. Alternatively, color printouts of photos with your name, email
address, mailing address and age can be mailed to: ThinkFun, Inc., 1321 Cameron Street, Alexandria.
Each entry received that proves that the player correctly solved the 36 Cube puzzle by photos supplied as proof and complete
registration will be deemed a potential winner. In case of a tie due to time of
entry submitted, a random drawing of potential winners will determine the tie. Submissions
that do not include all required information and adhere to the foregoing and
following requirements will be considered void and will not be judged in this
Contest. Your entry must meet the requirements set forth in all sections of the
Official Rules.
Previously, 19 out of a possible 36 prizes were won by puzzle solvers. For this contest, the remaining 17 Prizes will be awarded by a random drawing among all legitimate, un-awarded, eligible prize claims.
5. Winner Notification and Announcement: All selected potential winners must comply with all terms and conditions of the official rules, and all winnings are contingent upon fulfilling all requirements. Administrator is an independent judging organization whose decisions are final and binding in all matters related to the Contest. The potential winners will be notified by e-mail (via the e-mail account used to submit your entry) on or about May 1, 2009 or sooner if submissions are judged and verified as winning entries. The potential winners list will be announced on www.thinkfun.com/36Cube/contest.html on or about May 1, 2009.The potential winner will be required to execute and return a affidavit of eligibility and liability/publicity release (where legally permissible) within a reasonable amount of time, as determined by the Sponsor in its sole discretion. If a potential winner cannot be contacted by e-mail after the first attempt to contact him or her, or if he or she fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period (if applicable), the potential winner will be disqualified and an alternate entry will be selected in his or her place from all eligible entries received according to the judging criteria of the Contest. Only one alternate winner selection will be made for each prize, after which any remaining prizes will remain un-awarded.
6. Prizes: Seventeen (17) prizes: Think Fun Game Club Kit, comprised of an assortment of problem-solving games and puzzles (ARV $360), will be awarded to the potential winners elementary, middle, and junior or high school of their choice, including public or private nonprofit 5013(C) recognized schools located in the United States or District of Columbia. Total ARV of all prizes is $6,120. All contest prizes are nontransferable, except at the sole discretion of Think Fun, Inc. If a designated winners school choice does not accept the prize, Sponsor will select another school at its sole discretion. All taxes are the sole responsibility of the winner. This contest is void where prohibited or otherwise regulated. All federal, state and local laws apply.
7. Judging Criteria: Final judging will be based 100% on mathematical and problem solving skill in solving the 36 Cube puzzle correctly and submitting photo proof with your submission described in section four. To become a potential winner, you must solve and complete the 36 Cube puzzle and submit your entry. To solve the 36 Cube puzzle, you must start the puzzle by removing all 36 towers from the base and follow two rules: 1); there must be only one of each colored tower in every row and column and 2); the towers must fit into a base to form a perfect Cube with all towers being the same height. Decisions of the judges are final in all matters relating to Contest.
8. Publicity: Except where prohibited, participation in the 36 Cube contest constitutes winner’s consent to sponsor’s use of winners’ name, likeness, photograph, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
9. General Conditions: Sponsor reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor, Administrator and any promotional partners, each of their parent, subsidiary, affiliate and related companies, and each of its and their respective officers, directors, employees, and agents (collectively the “Released Parties”) from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Contest or resulting directly or indirectly, from acceptance, possession, use, or misuse of any prize awarded in connection with the Contest , including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy.
11. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process of the Contest; (4) technical or human error which may occur in the administration of the Contest or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use of any prize. Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
12. Disputes: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Virginia or the appropriate Virginia State Court located in; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event attorneys' fees; and (iii) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest , shall be governed by, and construed in accordance with, the laws of the State of Virginia , without giving effect to any choice of law or conflict of law rules (whether of the State of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Virginia.
